The court found that the claim was for trespass to land, which is a continuous tort. As long as the alleged trespass continues, a fresh cause of action arises each day, and therefore the Limitation of Actions Act (Cap 22) does not bar the suit. On the issue of res judicata, the court held that although the rights of the 1st defendant had been declared in a previous suit, the plaintiff was not a party to that litigation, nor were its agents. Since not all the conjunctive elements of res judicata were satisfied—specifically, the requirement that the parties be the same or claim under the same title—the doctrine did not apply.
