The High Court lacks jurisdiction to grant leave to appeal to the Court of Appeal against its own decision made under section 35 of the Arbitration Act. The Supreme Court and Court of Appeal have established that the residual jurisdiction to grant such leave is exclusively vested in the Court of Appeal and only in exceptional circumstances. The Arbitration Act is a self-contained code, and the provisions of the Civil Procedure Act and Rules do not apply unless expressly incorporated. Consequently, the High Court also lacks jurisdiction to grant a stay of execution of an arbitral award that it has recognized.
