Ratio Decidendi

The court held that once the value of the estate was determined to be KES 51,000,000, the Othaya Magistrates' Court immediately lost jurisdiction, as its pecuniary limit was exceeded. Citing binding appellate authority, the court found that a suit filed in a court without jurisdiction is a nullity and cannot be transferred to a competent court; the only remedy is withdrawal and refiling in the proper forum. The High Court therefore lacked power to transfer the incompetent cause to itself. The application for transfer was dismissed, and the applicant was directed to withdraw the suit in the magistrates' court and file a fresh compliant suit in the High Court at Nakuru if so advised.
