Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the trial court erred in granting divorce on the ground of irretrievable breakdown of marriage.
  2. 2 Whether the evidence adduced was sufficient to warrant dissolution of the marriage.
  3. 3 Whether the trial court properly evaluated the evidence and applied the law.

Ratio Decidendi

The High Court found that, despite the appellant's efforts to maintain the marriage, the evidence demonstrated that the marriage had irretrievably broken down. The respondent had moved on with a new family and had no intention of remaining married to the appellant. The court held that marriage is a union of two willing partners, and where one party is no longer interested, the court cannot impose the marriage by declining to grant divorce. The trial court correctly applied the law and evaluated the evidence, and there was no justification to overturn its decision. The appeal was therefore dismissed.
