The respondent did not deny that the applicant had renovated the premises at substantial cost or that rent was being paid as due. There was no inordinate delay in prosecuting the appeal or filing the application. The court held that it was in the interest of justice to preserve the suit premises pending the determination of the appeal. Accordingly, the court extended the stay of execution for twelve months, conditional on the applicant continuing to pay rent as due, with automatic vacation of the orders upon default.
