Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether the sentence of 20 years imprisonment for attempted murder was harsh and excessive in the circumstances.
  2. 2 Whether the trial court applied the correct legal principles in sentencing the appellant.

Ratio Decidendi

The High Court found that the trial court considered the relevant factors in sentencing, including the seriousness of the offence, the circumstances of the victim and appellant, and the need for deterrence. However, upon review of sentences in similar cases and considering the appellant's remorse and time already served, the High Court determined that a sentence of 15 years imprisonment was appropriate. The period already served in custody awaiting trial was also to be deducted from the sentence. The appeal on conviction was marked as abandoned, and only the sentence was reviewed downward.

Court Disposition

sentence reviewed downward; conviction appeal abandoned

Orders

  • Appeal on conviction is marked as abandoned.
  • Sentence reviewed by reducing to 15 years imprisonment.
