The court found that although the appeal had been dormant for over seven years and the appellant had failed to take steps to prosecute it, the dismissal order made on 6th July 2015 was procedurally defective because there was no evidence that notice of dismissal was served on the parties as required by Order 42 Rule 35(2) of the Civil Procedure Rules. The requirement for notice is mandatory, and its absence rendered the dismissal irregular. However, given the appellant's conduct and unexplained delay, the court exercised its discretion to set aside the dismissal order only on strict conditions: the appellant must pay the respondent thrown away costs of Kshs 5,000 within thirty days and...
