The court found that the judgment delivered on 29th September 2011 did not award any interest. The inclusion of interest in the decree was therefore an error on the face of the record. The court held that, under section 26(2) of the Civil Procedure Act, where a decree is silent on interest, the law deems interest at 6% per annum on the aggregate sum from the date of judgment to the date of payment. The court exercised its discretion to set aside the vague and arbitrary order on interest in the original decree and substituted it with a clear order for interest at 6% per annum on the aggregate sum from the date of judgment to payment.
