The Respondent admitted part of the debt but failed to prove that the disputed Kshs. 55,000/= was non-refundable share capital, as no evidence of such a provision in the SACCO bylaws was produced. The Tribunal held that the burden of proof rested on the Respondent, who failed to discharge it. The Tribunal also found the Respondent's proposed refund timeline of over a year to be unreasonable and unsupported by evidence. Consequently, the Claimant was entitled to the full refund of Kshs. 538,953/=, together with costs and interest at Tribunal rates.
