Ratio Decidendi

The court found that the applicant failed to prove any agreement entitling her to the ½ acre of land registered in the name of the deceased Regina. The land was given to Regina as an absolute gift by the previous owner, Nyamu Chira, and the applicant had no legal interest in it. The administrator followed the correct legal procedure, including gazettement of the succession proceedings, and there was no evidence of fraud or concealment. As the applicant was not a beneficiary or survivor of Regina, she was not entitled to notice of the proceedings. The court concluded that there was no basis for revocation of the grant and dismissed the application with costs to the respondent.
