The court found that its previous judgment contained a clerical error in the amount of general damages awarded to the respondent, having mistakenly indicated KShs.180,000/= instead of the correct figure of KShs.80,000/=. The error was apparent on the face of the record and was acknowledged by both parties. Applying Section 99 of the Civil Procedure Act and Order 45 rule 1(b) of the Civil Procedure Rules, the court held that it was empowered to correct such errors. The court accordingly reviewed the award on general damages downwards to KShs.80,000/= and apportioned liability equally between the parties, resulting in the appellant being liable for KShs.40,000/=.
