Ratio Decidendi

The trial court erred in failing to award costs to the appellant, the successful party, and in failing to provide any reasons for this omission. Section 27 of the Civil Procedure Act establishes that costs should ordinarily follow the event unless the court, for good reason, orders otherwise. The trial magistrate's silence on the issue of costs, despite a specific plea and the appellant's success, amounted to an error of law. The appellate court is entitled to intervene where the trial court gives no reasons for departing from the general rule on costs. Accordingly, the judgment of the lower court is varied to award costs to the appellant in both the lower court and on appeal.
