Ratio Decidendi

The High Court lacks original jurisdiction to determine disputes arising from decisions or orders of the Water Resources Management Authority regarding water permits and charges, as such disputes must first be brought before the Water Appeals Board under Section 85 of the Water Act, 2002. The parties had already reached a substantive settlement out of court, with the Plaintiff making payments and agreeing to register its borehole, leaving only the issue of costs unresolved. The pursuit of the present application was unnecessary, and the suit is terminated with costs to the Plaintiff up to the date of settlement, excluding costs for the prosecution of the application.
