The Tribunal's assessment was not plainly wrong or based on a misapprehension of the law or facts. However, the Tribunal erred by failing to provide reasons for setting the commencement date of the new rent as June 2023. The court held that, in fairness, the commencement date should be apportioned equally between the parties, resulting in a new effective date of 1st November 2021.
