The High Court held that although the Sexual Offences Act prescribes a mandatory life sentence for defilement of a child under eleven, recent jurisprudence allows courts to consider mitigating circumstances and impose lesser sentences where appropriate. The appellant, convicted of defiling a seven-and-a-half-year-old child, was sentenced to 30 years' imprisonment, which the appellate court found reasonable given the severity of the offence and the psychological harm caused to the minor. However, the trial court failed to account for the period the appellant spent in custody prior to sentencing, as required by section 333(2) of the Criminal Procedure Code.
