Procedural Posture

Land Appeal / Judgment

  1. 1 Whether the Land Tribunal had jurisdiction to determine the dispute regarding ownership of title.
  2. 2 Whether the Tribunal's decision was ultra vires its statutory mandate under the Land Dispute Tribunal Act (repealed).
  3. 3 Whether the Tribunal erred in finding the succession documents fraudulent without proper basis.

Ratio Decidendi

The court found that the Land Tribunal's decision did not address the issues within its statutory mandate, as it failed to determine a boundary dispute, right to occupy and work on land, or trespass, but instead purported to advise on ownership of title, which was outside its jurisdiction under Section 3(1) of the Land Dispute Tribunal Act (repealed). Consequently, the Tribunal's decision was ultra vires and a nullity. The award as adopted by the Magistrate's Court was therefore set aside. Each party was ordered to bear their own costs due to the family nature of the dispute.
