The court found that although the repealed Employment Act did not require mandatory reasons for dismissal, the Respondent failed to follow due process and did not provide valid reasons for the Claimant's summary dismissal. The Claimant was placed on compulsory leave, which was not provided for in the Respondent's terms and conditions of service, rendering the action unlawful. The Claimant was entitled to salary withheld during compulsory leave and one month's salary in lieu of notice. The Respondent's counterclaim was dismissed as it was not properly filed.
