The jurisdictional issue only arose after the applicants filed a counter-claim for adverse possession, which falls within the exclusive jurisdiction of the Environment and Land Court. The court found that the principle in Kagenyi v Musiramo does not apply where the original court had jurisdiction at the time of filing and only lost it due to subsequent pleadings.
