Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the appellants are entitled to bury the deceased on the suit land owned by the respondent.
  2. 2 Whether the respondent holds the suit land or any portion thereof in trust for the appellants and the deceased's dependants.

Ratio Decidendi

The Court of Appeal held that the respondent, as the registered proprietor of the suit land, enjoys absolute ownership under the Land Registration Act, 2012. The appellants failed to provide any documentary evidence of the alleged oral promise by the previous owner, Durani, to give the deceased 359.5 acres. Court Disposition

Appeal dismissed with costs to the respondent.

Orders

  • The appeal is dismissed with costs to the respondent.
  • The permanent injunction restraining the appellants from burying the deceased on the suit land is upheld.
