Ratio Decidendi

The court found that the rectification of the grant to include the whole of plot No. 4’A’ in the estate of John Muthee M’Ikiugu was improper and fraudulent, as the plot was jointly registered in the names of both John Muthee M’Ikiugu and M’Ikiugu M’Muthuri, both deceased. There was no evidence to rebut the presumption of equal ownership. The respondent’s application for rectification excluded the estate of M’Ikiugu M’Muthuri and thus prejudiced its beneficiaries. The court rejected the respondent’s procedural objections, holding that the applicants had proper locus standi under their limited grant and that procedural lapses such as failure to serve through the registrar were not fatal....
