Legal Issues
- 1 Whether the court should confirm the grant of letters of administration without a written distribution of assets among beneficiaries.
Ratio Decidendi
The court declined to confirm the grant of letters of administration because there was no written distribution of the deceased's assets among the beneficiaries on record. The judge held that the confirmation of grant requires the beneficiaries' entitlements to be clearly set out and filed before the court can consider confirmation. The absence of such a distribution is a procedural bar to confirmation, and the applicant must comply by filing the necessary documentation before the court can proceed.
Court Disposition
Confirmation of grant deferred pending filing of written distribution of assets.
Orders
- The applicant is directed to file a written distribution of assets among beneficiaries before the court can consider confirmation of the grant.

IN THE MATTER OF THE ESTATE OF FRANCIS KAMANDE GATHUA (DECEASED) AND LUCY NJERI KAMANDE ………….………………….…………PETITIONER RULING
The applicant Lucy Njeri Kamande has applied to this court by a Chamber Summons dated 28th February 2001 that the Letters of Administration to the estate of the late Francis Kamande Gathua issued on 10th August 2001 to Lucy Njeri Kamande and Paul Gachuhi Gathua be confirmed. I have perused the file and have not seen the division of the assets among the beneficiaries. I therefore direct that the written distribution of assets among beneficiaries be filed, before the matter can be considered by this court. Dated and Delivered at Eldoret this 21st Day of June 2004 George Dulu Judge
Ruling read in open court in the absence of the applicant. George Dulu Judge (I certify this a true copy of the original) DEPUTY REGISTRA
