The court found that the appellant was aware of the third party vehicle and its owner as early as the filing of the defence and from documents on record. The application for leave to issue a third party notice was made over a year after the suit commenced, far outside the prescribed period, and the explanations for the delay were inadequate and unconvincing. The lower court correctly found the delay inexcusable and exercised its discretion properly in refusing to extend time and declining leave to issue the third party notice. Allowing the application would have prejudiced the proceedings by reopening pleadings and causing further delay, contrary to the overriding objective of the court....
