Ratio Decidendi

The court found that the applicants had failed to provide any explanation or justification for the delay of more than four years in seeking to file an appeal out of time. The application and supporting affidavit were silent on the reasons for the delay, and no material was placed before the court to persuade it to exercise its discretion in the applicants' favour. Applying Section 79G of the Civil Procedure Act and the principles set out in Mwangi v Kenya Airways Ltd, the court held that the delay was inordinate and unexplained, and that there was no basis to grant the extension of time or any other relief sought. Consequently, the application was dismissed in its entirety with costs.
