Ratio Decidendi

The court, having reconsidered the representations made by the applicants' counsel regarding the potential prejudice arising from the admission of a disputed title deed during ex parte proceedings, found sufficient basis to treat the application for stay of proceedings as urgent. The risk that the trial court might uphold the disputed title before the appeal is heard constituted a real possibility of prejudice to the applicants. Accordingly, the court directed that the application be fixed for hearing on a priority basis, reversing its earlier refusal to certify urgency.
