Procedural Posture

Injunction Application / Ruling on Interlocutory Application for Temporary Injunction

  1. 1 Whether the plaintiff has established a prima facie case for grant of a temporary injunction against the defendants.
  2. 2 Whether the 2nd defendant is estopped from denying obligations to the plaintiff arising from the sale transactions.
  3. 3 Whether continued demand for rent by the 2nd defendant amounts to unjust enrichment and breach of contract.

Court Disposition

Plaintiff's application for temporary injunction allowed in part.

  • Pending hearing and determination of the suit, the plaintiff shall from 1st August 2017 and monthly thereafter pay rent, as per the agreement dated 7th November 2008, into a joint bank account in the names of the advocates for the plaintiff and the 2nd defendant.
