The court held that it was functus officio upon delivery of its judgment on 14th October 2021 and therefore lacked jurisdiction to entertain the Plaintiff/Applicant's notice of motion seeking extension or reinstatement of status quo orders. The application was found to be fatally and incurably defective for having been brought under Article 159 of the Constitution, which could not cure the procedural defects. Furthermore, the existence of pending appeals and similar applications before the Court of Appeal rendered the application before this court an abuse of process.
