Ratio Decidendi

The court found that the respondent failed to provide any valid or fair reason for terminating the claimant's employment and did not follow the mandatory procedural requirements set out in the Employment Act. No evidence was adduced by the respondent to justify the termination or to show that the claimant was accorded a fair hearing. The court held that the termination was therefore unfair within the meaning of section 45 of the Employment Act. The claimant was entitled to compensation for unfair termination and payment in lieu of notice, but not to general damages or a certificate of service, as the latter had already been issued.

  • The respondent shall pay the claimant Kshs. 20,000 being one month’s salary in lieu of notice.
