Upon re-evaluation of the evidence and submissions, the appellate court found that the suit land was family land, originally acquired by the parties' mother, and that the appellant was registered as proprietor in 1967 while still a minor, consistent with Kikuyu customary law practice of registering the eldest son as trustee for the family. The court held that the intention to create a customary trust was clear from the evidence, including the mother's witness statement and the continued occupation and use of the land by the siblings.
