Ratio Decidendi

The court found that the plea was properly taken in Kiswahili, which the appellants understood, and that the facts admitted by the appellants established both the actus reus and mens rea for the offence of stealing. The conviction was therefore safe. However, considering that the appellants were first offenders and the stolen items were recovered, the maximum sentence of three years was harsh and excessive. The sentence was reduced to eighteen months' imprisonment for each appellant, to be served from the date of conviction.
