Ratio Decidendi

The court found that although the defendant and his father had occupied the suit property since 1978 pursuant to a sale agreement, the defendant failed to prove that the full purchase price was paid. Without evidence of full payment, the occupation remained by permission and did not become adverse. Therefore, the defendant did not establish a claim for adverse possession. As the plaintiff's title was not impeached and adverse possession was not proved, the plaintiff is entitled to enjoy the rights of proprietorship, including a permanent injunction against the defendant.
