Legal Issues
- 1 Whether there was a reasonable basis for reviewing the order of Justice Omollo.
- 2 Whether the applicant provided sufficient reasons or evidence to warrant review of the previous order.
Ratio Decidendi
The court found that the applicant failed to provide any reasonable basis or sufficient reason for reviewing the order previously made by Justice Omollo. No new evidence or error apparent on the face of the record was demonstrated in the supporting affidavit or in oral submissions. Consequently, the application for review did not meet the threshold set by the Civil Procedure Rules, and the court was unable to grant the relief sought. The application was therefore dismissed with costs to the respondent.

Orders
- The application for review is dismissed with costs to the respondent.

MISC. APPLICATION NO.127 OF 2013
LUNAO AFRICAN DIVINE CHURCH…………………......………………..APPLICANT
VERSUS
SOLOMON WANYAMA KULULU………………………..………………..RESPONDENT
RULING
I have perused the notice of motion dated 8th July 2014. The supporting Affidavit supporting the same.
I have considered the submissions of Mr. Waswa Learned Counsel for the applicant and the reply by Mr. Anwar Learned Counsel for the respondent. I find no reasonable basis for reviewing the order of my learned colleague Justice Omollo. Not a single reason was submitted before me and none was exhibited in the Supporting Affidavits.
I am therefore unable to grant the application.
The same is dismissed with costs.
