Ratio Decidendi

The court held that the power to transfer a suit from a subordinate court to the High Court or a court of equal status can only be exercised if the subordinate court has competent jurisdiction to try and dispose of the matter. Where the subordinate court lacks pecuniary jurisdiction, as alleged in this case, the appropriate remedy is for the parties to move the lower court to strike out the suit or for the plaintiff to withdraw it. The court cannot transfer a suit that was incompetent ab initio due to lack of jurisdiction. Consequently, the application to transfer MC ELC No E287 of 2021 and set aside consequential orders was dismissed.
