Ratio Decidendi

The court found that although the Respondent's Managing Director was properly served with the tribunal order of 29th May, 2015 and did not comply with it, the subsequent stay of that order by the tribunal on 8th June, 2015 rendered it ineffective. Since the order was no longer in force at the time of hearing, there could be no willful disobedience or contempt. The court held that contempt proceedings cannot be sustained on an order that has ceased to have legal effect due to a stay, and thus declined to grant leave to commence committal proceedings.
