Ratio Decidendi

The court found that the tenancy contract which formed the basis of the appeal had expired by effluxion of time and the appellant had vacated the premises. As a result, the appeal had been overtaken by events and there was no longer any live issue for determination. The appellant was properly served with the application and hearing notices but failed to respond or attend court. In the absence of opposition, and given the mootness of the appeal, the court dismissed the appeal and ordered the appellant to bear the costs.
