The Tribunal found that while the Claimant is entitled to the fruits of her judgment, the Respondent demonstrated financial constraints and multiple pending claims, which would make compliance with the original order for monthly payments of Kshs.50,000 unduly burdensome. The Tribunal accepted that the Respondent's affidavit of means, filed prior to the ruling, was not adequately considered. In balancing the interests of justice, the Tribunal exercised its discretion to review the earlier order, reducing the monthly instalment to Kshs.25,000, payable until the decretal amount is fully settled. The Tribunal also awarded costs of Kshs.5,000 to the Claimant due to unnecessary expense caused...
