The court found that there was an error apparent on the face of the record in its earlier ruling of 6th December, 2021, specifically in ceding jurisdiction to the National Environment Tribunal (NET) while simultaneously staying the main Petition, which could result in the court exercising both original and appellate jurisdiction over the same matter. The Supreme Court's guidance in Benson Ambuti Adega & 2 Others v Kibos Distillers Ltd. & 5 Others (2020) eKLR requires the ELC to reserve constitutional issues pending the NET's determination of EIA licensing. The existence of potentially conflicting orders from the High Court and the ELC was also not fully appreciated in the earlier ruling....
