The court found that there was a communication breakdown during the confirmation proceedings, likely due to interpretation issues, resulting in the applicant's affidavit of protest not being considered. The court held that the confirmation of grant was therefore procedurally flawed. Applying the principle that the certificate of confirmation can be cancelled without affecting the validity of the parent grant, the court determined that the applicant's complaint was merited and ordered cancellation of the certificate of confirmation issued on 26th October 2006. The original certificate was to be returned to the court for cancellation, and costs were ordered to be in the cause.
