Procedural Posture

Civil Appeal / Ruling on Application for Leave to Appeal Out of Time and Stay of Execution Pending Appeal

  2. 2 Whether an order for stay of execution pending appeal should be granted and on what terms.

Court Disposition

Application allowed with conditions.

Orders

  • Stay of execution of the decree is granted pending the filing and determination of the intended appeal, on condition that the applicant deposits the decretal sum of KES 1,481,600 in an interest earning account in the joint names of counsels within 30 days.
