Ratio Decidendi

The court found that the marriage between the Petitioner and Respondent had irretrievably broken down, with both parties no longer living together and all attempts at reconciliation having failed. The court was satisfied, on a balance of probabilities, that the Petitioner had proved the matrimonial offence of cruelty. There was no evidence of collusion or condonation of the alleged offences. Both parties agreed that the marriage could not be salvaged. Accordingly, the court held that the legal threshold for dissolution of marriage under the Marriage Act had been met and granted a decree nisi to dissolve the marriage, to be made absolute after thirty days.
