The Court of Appeal lacks jurisdiction to entertain an appeal against the severity of sentence from the High Court in its appellate jurisdiction, as severity of sentence is a matter of fact, not law, and is expressly excluded by section 361(1) of the Criminal Procedure Code. The appellant's submission, being a mitigation statement and not a memorandum of appeal raising points of law, is not a valid appeal.
