Ratio Decidendi

The court found that the current petition is res judicata because it involves substantially the same cause of action, subject matter (LR No. 5865/2), and parties (or those in privity) as Mombasa ELC Petition No. 6 of 2019, which was determined on its merits. The previous petition was brought on behalf of all squatters on the suit land, and the reliefs sought in the present petition are strikingly similar. The doctrine of res judicata precludes the court from entertaining the matter again, as it would amount to reopening issues already conclusively determined.
