Ratio Decidendi

The court found that, according to section 39(1) of the Law of Succession Act, the objectors (protesters), as brothers and sisters or their children, rank higher in priority to inherit than the petitioner, a step brother. The court determined that the issue of entitlement to the estate, particularly regarding occupation of the disputed land and whether the objectors reside on the estate, required oral evidence for proper adjudication. Consequently, the court directed that the protest be determined by way of oral evidence, as affidavit evidence and submissions alone were insufficient to resolve the factual disputes regarding residence and entitlement.
