Review Application / Ruling on Application for Review of Previous Tribunal Order

  1. 1 Whether the Tenant is entitled to review and setting aside of the Tribunal's ruling delivered on 11.4.2024.
  2. 2 Whether the Tenant complied with the Tribunal's order to pay filing fees within the stipulated period.
  3. 3 Whether there was discovery of new and important evidence justifying review under Order 45 Rule 1 of the Civil Procedure Rules.

Ratio Decidendi

The Tribunal found that the Tenant failed to act within the seven-day window granted by the order of 11.4.2024 to pay the filing fees or bring to the Tribunal's attention any difficulties or the fact of reimbursement to the Landlord's counsel. The Tribunal held that the information regarding payment should have been presented within the stipulated period, and the Tenant's delay rendered the application for review incompetent. Furthermore, the Tribunal was not satisfied that there was any discovery of new and important evidence or an error on the face of the record to justify review under Order 45 Rule 1 of the Civil Procedure Rules. The application was therefore dismissed as lacking merit.
