The assertion that counsel was unaware of related matters was not credible, as the responses were available prior to the hearing. The withdrawal of the application only after the conclusion of the hearing of preliminary objections, and after the respondents and interested parties had expended resources, did not entitle the applicant to avoid liability for costs.
