Ratio Decidendi

The Tribunal found that although the orders of 8th February 2024 were issued in the absence of the Tenant, the Landlord had filed proof of service. The Tenant did not deny that he vacated the premises and that the premises had been let to another party. As the tenancy relationship had already ended and the premises were re-let, the Tribunal held it lacked jurisdiction to entertain the Tenant's application to set aside the orders. The application was therefore dismissed.
