Ratio Decidendi

The court found that while the trial court correctly declared the towing and detention of the appellant's motor vehicle illegal, it erred in dismissing the entire claim for special damages. The appellant only proved Kshs. 5,000 as the cost of the assessment report, as there was no evidence to support the claim for Kshs. 5,000 per day for loss of business or for the full amount of repair costs. The court therefore allowed the appeal to the extent of awarding Kshs. 5,000 as special damages and upheld the declaration of illegality regarding the towing.
