The court found that the accused, having pleaded guilty to manslaughter and shown remorse, was entitled to consideration of mitigating factors, including his rehabilitation efforts, family support, and lack of previous criminal record. However, the gravity of the offence, involving the death of a 95-year-old grandmother following rape and assault by her grandson, required a custodial sentence to balance justice for the deceased and the interests of society. The court exercised its discretion under the Penal Code to impose a sentence of fifteen years' imprisonment, less the period already spent in custody since arraignment, in accordance with section 333(2) of the Criminal Procedure Code....
