The court found that the sale transaction between the plaintiff and defendant for agricultural land was void for lack of Land Control Board consent as required by the Land Control Act. The defendant, having not obtained any legal interest in parcel Nandi/Kapkangani/437, had no right to occupy it. The plaintiff, as the registered owner, was entitled to seek eviction and a permanent injunction. The court also noted that the only remedy available to the defendant would be a refund of the purchase price as a debt, subject to the limitation period for recovery of debts.
