Procedural Posture

Environment and Land Case / Judgment

  1. 1 Whether the plaintiff is the lawful registered proprietor of Nyeri Municipality Block II/371 entitled to possession thereof.
  2. 2 Whether the defendants' occupation of the suit property is unlawful and warrants eviction.
  3. 3 Whether the plaintiff's title was obtained fraudulently and should be cancelled as sought in the 3rd defendant's counterclaim.

Ratio Decidendi

The court found that the plaintiff is the registered proprietor of the suit property, having acquired title through a process that involved due diligence by the Ministry of Lands. The 3rd defendant's earlier letter of allotment did not confer a registrable interest, and there was no sufficient evidence of fraud or misrepresentation by the plaintiff in obtaining its title. The doctrine of indefeasibility of title under Section 26(1) of the Land Registration Act protects the plaintiff's ownership, and the 3rd defendant's counterclaim based on an allotment letter cannot defeat the registered title. The 1st and 2nd defendants' occupation, derived from the 3rd defendant, is therefore unlawful....

Court Disposition

Judgment for the plaintiff; 3rd defendant's counterclaim dismissed; eviction order granted; mesne profits claim dismissed.

Orders

  • The 3rd defendant's counterclaim is dismissed with costs to the plaintiff.
  • The defendants are ordered to vacate, quit and yield possession of LR. No. Nyeri Municipality Block II/371 within 30 days from the date of judgment, failing which the Court Bailiff shall evict them forthwith.
