The Plaintiff did not produce evidence that all plots had been sold or that the Defendant personally received the proceeds. Furthermore, the Plaintiff failed to sue Saminico Limited, the proper party to the agreement. The court held that it could not rewrite the contract to suit the Plaintiff's claims and that the Plaintiff had not proved his case on a balance of probabilities....
